Please read these Terms of Service carefully before using the Services.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", or "User") and Stakyo, LLC, a Delaware Limited Liability Company ("Stakyo", "we", "us", or "our"), regarding your access to and use of the polyscout.co website (the "Site"), the Polyscout iOS application (the "App"), and related services (collectively, the "Services"). The App is distributed through the Apple App Store.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old to use the Services. By using the Services, you represent that you are at least 18 and have the legal capacity to enter into a binding contract.

The Services are not available to users in countries subject to U.S. export restrictions or sanctions, including but not limited to Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions.

3. About Polyscout — Important Disclosures

Independent service. Polyscout is an independent tracking and analytics service. Polyscout is not affiliated with, endorsed by, or sponsored by Polymarket or any related entities.

No financial or betting advice. Polyscout does not place trades, execute transactions, hold custody of funds, or provide financial, investment, trading, or betting advice. All information presented in the Services is for informational and research purposes only.

Data accuracy. Market data, trader activity, and alerts are derived from publicly available sources and may be delayed, incomplete, or subject to change. Accuracy is not guaranteed.

User responsibility. You are solely responsible for any decisions or actions you take based on information from the Services.

4. Account Registration and Security

To use certain features you must create an account. You agree to provide accurate information and to keep it current. You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately at support@stakyo.com of any unauthorized access. You may not maintain more than one account or transfer your account to anyone else.

5. License Grant and Restrictions

Subject to your compliance with these Terms, Stakyo grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial purposes.

You shall not: (a) copy, modify, or create derivative works of the Services; (b) reverse engineer, decompile, or disassemble the App or attempt to derive source code; (c) rent, lease, sell, sublicense, or otherwise commercially exploit the Services; (d) remove or alter proprietary notices; (e) use automated means (bots, scrapers, crawlers) to access the Services without our prior written permission; (f) interfere with or disrupt the Services or attempt unauthorized access; (g) use the Services to violate any law or the rights of others.

6. Subscriptions and Billing

Polyscout offers paid subscription plans ("Polyscout Pro"). Subscriptions purchased through the App are processed by Apple under the terms of your Apple ID account.

Auto-renewal. Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the end of the current period. Your Apple ID is charged for renewal at the price disclosed at the time of purchase.

Free trials. If a free trial is offered, your subscription will begin and the chosen plan will be billed automatically at the end of the trial unless you cancel before the trial ends.

Managing and canceling. You can manage or cancel your subscription at any time in your Apple ID account settings (Settings → [your name] → Subscriptions). Cancellation takes effect at the end of the current billing period.

Refunds. Refunds for subscriptions purchased through the App are handled by Apple in accordance with Apple's policies. Stakyo does not process refunds for App Store transactions.

Price changes. We may change subscription prices. Any change will apply only to renewals occurring at least 30 days after notice and you may cancel before the new price takes effect.

Taxes. All fees are exclusive of applicable taxes, which are handled by Apple as part of the transaction.

7. Intellectual Property

The Services and all content, features, and functionality are owned by Stakyo, its licensors, or other providers and are protected by United States and international intellectual property laws. The Polyscout name, logo, and related marks are trademarks of Stakyo. You may not use them without our prior written permission. Any feedback or suggestions you provide may be used by us without obligation or compensation to you.

8. Prohibited Activities

You agree not to: use the Services in any manner that could damage or impair them; introduce viruses or malicious code; attempt to access accounts or systems you are not authorized to access; use the Services for unlawful, fraudulent, or harmful purposes; impersonate any person or entity; or violate any applicable law or regulation.

9. Third-Party Services and Links

The Services rely on and reference third-party platforms and services, including Polymarket data sources, Apple, Supabase, and Superwall. We do not control and are not responsible for the content, policies, or practices of third-party services. Use of those services is governed by their own terms.

10. Termination

You may stop using the Services at any time and may request account deletion by contacting support@stakyo.com. We may suspend or terminate your access at any time, with or without notice, for any reason, including breach of these Terms. Provisions that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, and indemnification.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, OR ERROR-FREE. ANY DECISION YOU MAKE BASED ON INFORMATION FROM THE SERVICES IS AT YOUR SOLE RISK.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL STAKYO, LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO STAKYO IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

13. Indemnification

You agree to defend, indemnify, and hold harmless Stakyo, LLC and its members, managers, officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Before filing any claim, you agree to attempt informal resolution by contacting support@stakyo.com. If a dispute is not resolved within 30 days, either party may bring formal proceedings in the state or federal courts located in Delaware. Both parties consent to the exclusive jurisdiction of those courts.

Class action waiver. Any dispute will be resolved on an individual basis. You agree not to participate in any class, representative, or collective action against Stakyo.

15. Changes to These Terms

We may update these Terms from time to time. The current version is identified by the "Last Updated" date. Material changes will be communicated through the Site or the App. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

16. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver. These Terms together with the Privacy Policy constitute the entire agreement between you and Stakyo regarding the Services. We may assign these Terms; you may not assign them without our written consent.

17. iOS App-Specific Terms

The following terms apply specifically to your use of the Polyscout iOS App and are required by Apple's App Store distribution terms.

Acknowledgment. These Terms are concluded between you and Stakyo, LLC only, not with Apple Inc. Stakyo, not Apple, is solely responsible for the App and its content. The terms of this License are limited to the App. You acknowledge that Apple has no obligation to provide any maintenance or support services for the App.

Scope of License. The license granted to you for the App is limited to a non-transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Apple Media Services Terms and Conditions and Apple's Usage Rules.

Maintenance and Support. Stakyo is solely responsible for providing any maintenance and support services for the App. Apple has no obligation whatsoever to provide maintenance and support for the App.

Warranty. Stakyo is solely responsible for any product warranties, whether express or implied, to the extent not effectively disclaimed. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App.

Product Claims. Stakyo, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your possession or use of the App, including: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation.

Intellectual Property Rights. In the event of any third-party claim that the App or your use of the App infringes that third party's intellectual property rights, Stakyo, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.

Legal Compliance. You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-Party Terms. You must comply with applicable third-party terms of agreement when using the App.

Apple as Third-Party Beneficiary. You acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
